Provisions.

 

REGULATIONS ON THE LEGAL COMMITTEE OF THE NATIONAL OLYMPIC COMMITTEE OF UKRAINE

 

1. The Legal Commission of the National Olympic Committee of Ukraine (hereinafter referred to as the NOC of Ukraine and the Commission) is a collegial advisory body of the Executive Committee of the NOC of Ukraine, which is established to deepen and improve the work of the Executive Committee in the legal field and in matters of interaction of the NOC of Ukraine with public authorities and governments.

 

2. In its activities, the Commission shall be guided by the Constitution of Ukraine, laws of Ukraine, acts of the Verkhovna Rada of Ukraine, the President of Ukraine and the Cabinet of Ministers of Ukraine, other regulatory legal acts of Ukraine, the Olympic Charter, the Statute of the NOC of Ukraine and this Regulation.

 

3. The Regulation on the Commission shall be approved by the Executive Committee of the NOC of Ukraine upon the proposal of the Head of the Commission.

 

4. The Commission shall act to involve members of the NOC of Ukraine and specialists in physical culture and sports, representatives of public authorities and governments in the development of the Olympic Movement in Ukraine, to protect the rights of members of the Olympic Movement, to comply with the requirements of national and international regulations and to ensure the work of the NOC of Ukraine.

 

5. The main tasks of the Commission are:

5.1. to promote the legal support of the activities of the NOC of Ukraine and its branches, subjects of the Olympic Movement;

5.2. coordinating law-making work, in particular improving the quality of draft regulatory legal acts and accompanying materials to them, participating in the preparation of draft laws and drafts of other regulatory legal acts, conclusions and justifications to them, facilitating the timely examination of draft laws submitted to the NOC of Ukraine for approval;

5.3. ensuring the legal protection of the Olympic symbols and intellectual property of the NOC and the IOC.

6. The Commission in accordance with its tasks:

6.1. Develops draft legislative acts on the development and popularisation of the Olympic Movement and sports of higher achievements, provides and prepares draft written conclusions, comments and recommendations to them;

6.2. Consider issues of interaction of the NOC of Ukraine with the relevant ministries on issues related to the preparation, examination, draft legislation, revision of departmental regulations in order to bring them into compliance with the legislation, prepares proposals for improving the legal framework for cooperation with the relevant central and local executive authorities;

6.3. Summarises the practice of legislation in the field of physical culture and sport, prepares proposals for its improvement, submits them to the management of the NOC of Ukraine for consideration to decide on the need to prepare a draft legislative act and submit it in accordance with the established procedure to the state body authorised to adopt such acts;

6.4. Provides recommendations on the interaction of the NOC of Ukraine with the Secretariat of the President of Ukraine, the Verkhovna Rada of Ukraine, the Cabinet of Ministers of Ukraine, other central and local executive authorities;

6.5. Organises work on raising the level of legal knowledge of the Olympic Movement participants, informs about changes in legislation, explains the existing practice of its application, and provides advice on legal issues.

 

7. The Commission has the right to:

7.1. to involve members of the NOC of Ukraine, specialists of the NOC of Ukraine Executive Directorate, experts in consideration of issues within its competence;

7.2. receive information from the Executive Board of the NOC of Ukraine, members of the NOC of Ukraine and other subjects of the Olympic Movement necessary for the performance of its tasks;

7.3. initiate the creation of working groups with the involvement of members of the NOC of Ukraine and representatives of public authorities.

 

8. The Legal Commission shall consist of not less than 5 and not more than 20 members, including:

  • Chairman;
  • Deputy Chairman;
  • members of the commission.

9. The commission may include members of the NOC of Ukraine, representatives of the Olympic Movement, representatives of state and public structures of Ukraine, specialists and experts whose activities are directly related to the work of the commission.

Each commission shall include a representative of the Athletes' Commission of the NOC of Ukraine.

 

10. The Chairperson, Deputy Chairperson and composition of the Commission shall be approved by the decision of the Executive Committee of the NOC of Ukraine upon the proposal of the President of the NOC of Ukraine. The decision shall be taken by a majority vote. This rule does not apply to the procedure for forming the Athletes' Commission.

 

11. The procedure for the formation and election of the management of the NOC Athletes' Commission shall be carried out in a special procedure determined by the Regulations on the Athletes' Commission.

 

12. Members of the Commission may be removed from the Commission only on the basis of a decision of the NOC of Ukraine Executive Committee at their own request or on the proposal of the President of the NOC of Ukraine.

 

13. The Chairman of the Commission has the following powers:

13.1. Organise the work of the Commission;

13.2. Holds and presides over the meetings of the Commission;

13.3. Organise the work of the commission members in accordance with the direction of work and the work plan of the commission;

13.4. Develops and submits the work plan of the Commission for approval at the meeting of the Commission.

13.5. Participates in the formation of the Commission's composition;

13.6. Sign the minutes of the meetings, conduct correspondence on behalf of the Commission;

13.7. Reports to the Executive Committee of the NOC of Ukraine on the work of the Commission and prepares materials on specific issues for its meetings;

13.8. Submits proposals to the budget.

 

14. The Deputy Chairperson of the Commission shall be approved by the NOC Executive Committee together with the composition of the Commission. The Deputy Chairman of the Commission shall act as Chairman in his/her absence.

 

15. The Secretary of the Commission shall be a staff member of the Executive Directorate of the NOC of Ukraine appointed by the relevant order of the Executive Director.

The Secretary of the Commission shall keep minutes of the Commission's meetings, collect and prepare materials for the Commission's meetings, and perform other instructions of the Head of the Commission in accordance with his/her powers.

He/she shall have an advisory vote at the meetings of the Commission.

 

16. The main form of work of the Commission is a meeting.

Meetings of the Commission shall be held at least 2 times a year or more often, if necessary.

At the meetings of the commission, issues are considered in accordance with the work plan of the commission.

Meetings of the commission shall be held in public or in private. The commission shall decide on the form of the meeting prior to the meeting.

A meeting of the commission shall be deemed to be competent if at least half of the total number of its members are present.

Resolutions of the commission, except as expressly provided for in the regulations on a particular commission, shall be adopted by a simple majority of votes. In the event of a tie, the Chairman of the commission shall have a casting vote.

In case of impossibility to participate directly (business trip, illness, etc.) in the meeting of the Commission, the members of the Commission have the right to participate in the meeting by establishing a video link, giving at least two business days' notice.

In the event of an urgent need, the Commission's decisions may be made by poll.

 

17. The President of the NOC of Ukraine or any member of the Executive Committee may participate in the work of the Commission.

 

18. The material, technical and financial support of the Commission's activities shall be provided by the NOC of Ukraine in accordance with the approved budget.

 

19. The Head of the Commission and its members are provided with guarantees of activity:

  • the possibility of attending events related to the performance of tasks assigned to the Commission;
  • independence in decision-making;
  • other guarantees related to the performance of tasks assigned to the commission.

 

20. Control over the activities of the Commission shall be exercised by the Executive Board of the NOC of Ukraine, and in the intervals between meetings of the Executive Board of the NOC of Ukraine - by the President of the NOC of Ukraine.

The Head of the Commission shall report to the Executive Committee of the NOC of Ukraine on the work carried out at least once a year. The order and procedure of reporting shall be determined by the NOC of Ukraine Executive Board.

In case the work of the Commission is found to be unsatisfactory, the NOC of Ukraine Executive Board may decide to terminate its work or re-elect the members of the Commission. Such a decision shall be made at a meeting of the Executive Committee by at least two-thirds of the votes of the members present.
