Provisions.
REGULATIONS ON THE COMMISSION OF THE NATIONAL OLYMPIC COMMITTEE OF UKRAINE "ATHLETE'S ENTOURAGE"
1. The Commission of the National Olympic Committee of Ukraine (hereinafter referred to as the NOC of Ukraine) "Athlete's Entourage" (hereinafter referred to as the Commission) is a collegial advisory body of the Executive Committee of the NOC of Ukraine, which is created to deepen and improve the work of the Executive Committee in accordance with the areas of its activity and to fulfil its statutory tasks.
2. In its activities, the Commission shall be guided by the Constitution of Ukraine, laws of Ukraine, acts of the President of Ukraine, the Cabinet of Ministers of Ukraine, other legislative acts, the Olympic Charter, the International Olympic Committee Code of Ethics, the Anti-Doping Code, the Statute of the National Olympic Committee of Ukraine and this Regulation.
3. The activities of the Commission shall be regulated by its Regulation. The Regulation on the Commission shall be approved by the Executive Committee of the NOC of Ukraine upon the proposal of the Head of the Commission.
4. The Commission shall act to comprehensively support and protect clean athletes by engaging and uniting stakeholders, in particular with respect to establishing effective relationships between athletes, parents, coaches, managers, technical officials, sponsors, media representatives and other stakeholders who support and work directly with athletes.
5. The main tasks of the Commission are:
- Consideration at meetings of the NOC of Ukraine in accordance with the areas of work for which the Commission is responsible;
- making decisions on issues within the competence of the Commission;
- facilitate communication with all people related to athletes, including: managers, agents, coaches, medical personnel, scientists, employees of sports organisations, sponsors, lawyers and any persons who contribute to the athletes' sports career, including family members.
The decisions of the Commission are advisory in nature and are subject to mandatory approval by the Executive Committee of the NOC of Ukraine.
The decisions of the Commission shall come into force from the date specified in the decision of the Executive Committee of the NOC of Ukraine. If such date is not specified, then from the moment of their approval by the Executive Committee of the NOC of Ukraine.
6. The Commission in accordance with its tasks:
1) consider documents, letters, appeals, applications, statements, explanations submitted by the subjects of the Olympic Movement in accordance with the direction of its work; 2) at its meetings it hears the subjects of the Olympic Movement; 3) involves experts, specialists in the relevant field in its work; 4) provide recommendations for solving problematic issues highlighted in documents, letters, appeals, statements and inform the NOC of Ukraine Executive Board of its decision; 5) within its competence resolve the issue of providing assistance to the subjects of the Olympic Movement, including financial assistance; 6) perform other functions arising from the tasks assigned to it.
7. The Commission shall have the right to: - involve members of the NOC of Ukraine, specialists of the NOC of Ukraine Executive Board, experts and specialists in consideration of issues within its competence; - receive information from the NOC of Ukraine Executive Board, members of the NOC of Ukraine and other subjects of the Olympic Movement necessary for the performance of its tasks.
8. The Commission consists of not less than 5 and not more than 20 members, including:
- Chairman;
- Deputy Chairman;
- a member of the Athletes' Commission of the NOC of Ukraine;
- members of the Commission.
9. The Commission may include members of the NOC of Ukraine, representatives of the Olympic Movement, representatives of state and public structures of Ukraine, specialists and experts whose activities are directly related to the work of the Commission.
10. The Chairperson, Deputy Chairperson and the composition of the Commission shall be approved by the decision of the Executive Committee of the NOC of Ukraine upon the proposal of the President of the NOC of Ukraine. The decision shall be made by a majority vote. This rule does not apply to the procedure for forming the Athletes' Commission.
11. The members of the Commission may be removed from the Commission only on the basis of a decision of the Executive Committee of the NOC of Ukraine on their own free will or on the proposal of the President of the NOC of Ukraine.
12. The Chairman of the Commission has the following powers:
12.1. Organise the work of the Commission;
12.2. Holds and presides over the meetings of the Commission;
12.3. Organise the work of the commission members in accordance with the direction of work and the work plan of the commission;
12.4. Develops and submits the work plan of the Commission for approval at the meeting of the Commission.
12.5. Participates in the formation of the Commission's composition;
12.6. Signs the minutes of the meetings, conducts correspondence on behalf of the Commission;
12.7. Reports to the Executive Committee of the NOC of Ukraine on the work of the Commission and prepares materials on specific issues for its meetings;
12.8. Submits proposals to the budget.
13. The Deputy Chairperson of the Commission shall be approved by the NOC Executive Committee together with the composition of the Commission. The Deputy Head of the Commission shall act as the Head during his/her absence.
14. The Secretary of the Commission shall be a staff member of the Executive Directorate of the NOC of Ukraine appointed by the relevant order of the Executive Director.
The Secretary of the Commission shall keep minutes of the Commission's meetings, collect and prepare materials for the Commission's meetings, and perform other instructions of the Head of the Commission in accordance with his/her powers.
He/she shall have an advisory vote at the meetings of the Commission.
15. The main form of work of the Commission is a meeting.
Meetings of the Commission shall be held at least 2 times a year or more often, if necessary.
At the meetings of the commission, issues are considered in accordance with the work plan of the commission.
Meetings of the commission shall be held in public or in private. The commission shall decide on the form of the meeting prior to the meeting.
A meeting of the commission shall be deemed to be competent if at least half of the total number of its members are present.
Resolutions of the commission, except as expressly provided for in the regulations on a particular commission, shall be adopted by a simple majority of votes. In the event of a tie, the chairman of the commission shall have a casting vote.
16. The President of the NOC of Ukraine or any member of the Executive Committee may participate in the work of the Commission.
17. The material, technical and financial support of the Commission's activities shall be provided by the NOC of Ukraine in accordance with the approved budget.
18. The Head of the Commission and its members are provided with guarantees of activity:
- the possibility to attend events related to the performance of tasks assigned to the Commission;
- independence in decision-making;
- other guarantees related to the performance of tasks assigned to the commission.
19. Control over the activities of the Commission shall be exercised by the Executive Board of the NOC of Ukraine, and in the intervals between meetings of the Executive Board of the NOC of Ukraine - by the President of the NOC of Ukraine.
The Head of the Commission shall report to the Executive Committee of the NOC of Ukraine on the work carried out at least once a year. The order and procedure of reporting shall be determined by the NOC of Ukraine Executive Board.
In case the work of the Commission is found to be unsatisfactory, the NOC of Ukraine Executive Board may decide to terminate its work or re-elect the members of the Commission. Such a decision shall be made at a meeting of the Executive Committee by at least two-thirds of the votes of the members present.
