Recommended clauses
1. Arbitration clause for a contract
(1) If the parties wish to refer a dispute for resolution in accordance with the CAS Rules, they may include an arbitration clause in their contract in the following form:
All disputes or claims arising out of or in connection with this contract, including disputes relating to its validity, breach, termination or invalidity, shall be finally settled under the Rules of the Sports Arbitration Court at the National Olympic Committee of Ukraine by one or three arbitrators appointed in accordance with these Rules.
(2) The parties may further agree in the arbitration clause on the number of arbitrators (one or three) (Article 15(1) of the CAS Rules) and the language of the arbitration proceedings (Article 24(1) of the CAS Rules).
2. Arbitration clause for sports bodies
(1) If a sports entity (a national federation for a particular sport, etc.) intends to provide in its constitutional documents for the possibility of referring disputes between its members for resolution in accordance with the CAS Rules, it may include an arbitration clause in its constitution, in particular, but not limited to, in the following form:
Decisions, acts and/or omissions of the governing bodies of [name of sports body], where there are grounds for doing so, may be appealed by a member of [name of sports body] whose rights and/or legitimate interests have been infringed, to the Sports Arbitration Court at the National Olympic Committee of Ukraine for a final decision by one or three arbitrators appointed in accordance with the Rules of the Sports Arbitration Court at the National Olympic Committee of Ukraine in the manner set out in these Rules.
(2) If a sports body (a national federation for a particular sport, etc.) intends to provide in its (disciplinary) statutory documents for the possibility of appealing against decisions made by its disciplinary bodies (disciplinary (qualification) commissions, dispute resolution chambers, sports tribunals, etc.) by way of appeal in accordance with the CAS Rules, it may include an arbitration clause in its constitution, in particular, but not exclusively, in the following form:
Any decision [name of the sports body’s disciplinary body] may be finally appealed against exclusively through the appeal arbitration procedure under the Rules of the Sports Arbitration Court at the National Olympic Committee of Ukraine by one or three arbitrators, appointed in accordance with these Rules, within 30 days of the date on which the appealing party received the decision being appealed.
