Provisions.

REGULATIONS ON THE COMMISSION OF THE NATIONAL OLYMPIC COMMITTEE OF UKRAINE "UKRAINIANS ABROAD"

1. The Commission of the National Olympic Committee of Ukraine "Ukrainians Abroad" (hereinafter referred to as the NOC of Ukraine Commission) is a collegial advisory body of the Executive Committee of the NOC of Ukraine, which is created to deepen and improve the work of the Executive Committee in accordance with the areas of its activity and to fulfil its statutory tasks.

2. In its activities, the NOC of Ukraine Commission shall be guided by the Constitution of Ukraine, laws of Ukraine, acts of the President of Ukraine, the Cabinet of Ministers of Ukraine, other legislative acts, the Olympic Charter, the International Olympic Committee Code of Ethics, the Anti-Doping Code, the Charter of the National Olympic Committee of Ukraine, statutory documents of international sports and fitness organisations, as well as this Regulation.

3. The activities of the NOC of Ukraine Commission shall be governed by its Regulations approved by the Executive Committee of the NOC of Ukraine upon the proposal of the Head of the Commission.

4. The Commission of the NOC of Ukraine shall act to involve members of the NOC of Ukraine and specialists in physical culture and sports, as well as specialists of Ukrainians abroad in the development of the Olympic Movement in Ukraine, to protect the rights of members of the Olympic Movement, to ensure deepening of cooperation with Ukrainians abroad by popularising the achievements of Ukrainian athletes and promoting a healthy lifestyle, to comply with the requirements of national and international regulations and to ensure certain areas of work of the NOC of Ukraine.

5. The main tasks of the Commission of the NOC of Ukraine are:

• Consideration at the meetings of the NOC of Ukraine in accordance with the areas of work for which the NOC Commission of Ukraine is responsible.
• making decisions on issues within the competence of the NOC Commission of Ukraine.

Decisions of the NOC Commission of Ukraine are advisory in nature and are subject to mandatory approval by the Executive Committee of the NOC of Ukraine.

Decisions of the NOC Commission of Ukraine shall enter into force on the date specified in the decision of the NOC Executive Committee of Ukraine. If no such date is specified, then from the date of their approval by the Executive Committee of the NOC of Ukraine.

6. The Commission of the NOC of Ukraine in accordance with its tasks:

1) examine documents, letters, appeals, statements, explanations submitted by the subjects of the Olympic Movement, international sports and fitness public organisations of Ukrainians abroad and private individuals whose purpose is to promote Olympic ideas and healthy lifestyle in accordance with the areas of its work

2) at its meetings hear the subjects of the Olympic Movement and representatives of international sports and fitness public organisations founded by Ukrainians abroad;

3) involve experts and specialists in the relevant field in its work;

4) provide recommendations for resolving problematic issues highlighted in documents, letters, appeals, statements and inform the Executive Committee of the NOC of Ukraine of its decision;

5) within the limits of its competence, resolve issues on providing assistance to the subjects of the Olympic Movement, representatives of international sports and fitness public organisations and individuals whose purpose is to promote Olympic ideas and healthy lifestyle, including financial assistance;

6) perform other functions arising from the tasks assigned to it.

7. The Commission of the NOC of Ukraine has the right to:

• Involve members of the NOC of Ukraine, specialists of the Executive Board of the NOC of Ukraine, experts and specialists, including those from international sports and fitness organisations established by Ukrainians abroad, in consideration of issues within its competence;
• receive information from the Executive Board of the NOC of Ukraine, members of the NOC of Ukraine and other subjects of the Olympic Movement necessary to perform its tasks.

8. The Commission of the NOC of Ukraine "Ukrainians Abroad" consists of not less than 5 and not more than 16 members, including:

• Chairman;
• Deputy Chairman;
• members of the Commission.

9. The Commission of the NOC of Ukraine may include members of the NOC of Ukraine, representatives of the Olympic Movement, representatives of state public structures of Ukraine and countries of the world where Ukrainians abroad live, specialists and professionals whose activities are directly related to the work of the Commission.

10. The Chairperson, Deputy Chairperson and members of the NOC of Ukraine Commission shall be approved by the decision of the Executive Committee of the NOC of Ukraine upon the proposal of the President of the NOC of Ukraine.

11. Members of the NOC of Ukraine Commission may be removed from the Commission only on the basis of a decision of the NOC of Ukraine Executive Committee at their own request or on the proposal of the President of the NOC of Ukraine.

12. The Chairman of the NOC of Ukraine Commission has the following powers:

12.1. Organise the work of the Commission;

12.2. Holds and presides over meetings of the Commission;

12.3 Organises the work of the members of the Commission in accordance with the areas of work and the work plan of the Commission;

12.4. Develops and submits the work plan of the Commission for approval at the meeting of the Commission.

12.5. Participates in the formation of the Commission's composition;

12.6. Sign the minutes of the meetings, conduct correspondence on behalf of the Commission;

12.7. Reports to the Executive Committee of the NOC of Ukraine on the work of the Commission and prepares materials on specific issues for its meetings;

12.8. Submits proposals to the budget.

13. The Deputy Chairman of the Commission of the NOC of Ukraine shall be approved by the NOC Executive Committee together with the composition of the Commission. The Deputy Chairperson of the Commission shall act as the Chairperson during his/her absence.

14. The Secretary of the Commission shall be a staff member of the Executive Board of the NOC of Ukraine appointed by the relevant order of the Executive Board.

The Secretary of the Commission shall keep minutes of the Commission's meetings, collect and prepare materials for the Commission's meetings, and perform other instructions of the Head of the Commission in accordance with his/her powers.

He/she shall have an advisory vote at the meetings of the Commission.

15. The main form of work of the Commission of the NOC of Ukraine is a meeting.

Meetings of the Commission shall be held at least 2 times a year or more often, if necessary.

The Commission shall consider issues in accordance with the Commission's work plan.

Meetings of the commission shall be held in public or in private. The commission shall decide on the form of the meeting prior to the meeting.

A meeting of the commission shall be deemed to be competent if at least half of the total number of its members are present.

Decisions of the commission shall be made by a simple majority of votes. In case of equality of votes, the Chairman of the commission shall have a casting vote.

16. The President of the NOC of Ukraine or any member of the Executive Committee may participate in the work of the Commission.

17. The logistical and financial support of the activities of the NOC Commission of Ukraine shall be provided at the expense of the NOC of Ukraine in accordance with the approved budget.

18. The Head of the NOC Commission of Ukraine and its members shall be provided with guarantees of activity:

• the possibility to attend events related to the performance of the tasks assigned to the Commission;
• independence in decision-making;
• other guarantees related to the performance of the tasks assigned to the Commission.

19. Control over the activities of the Commission shall be exercised by the Executive Board of the NOC of Ukraine, and in the intervals between meetings of the Executive Board of the NOC of Ukraine - by the President of the NOC of Ukraine.

The Head of the Commission shall report to the Executive Committee of the NOC of Ukraine on the work carried out at least once a year. The order and procedure of reporting shall be determined by the NOC of Ukraine Executive Board.

In case the work of the Commission is found to be unsatisfactory, the NOC of Ukraine Executive Board may decide to terminate its work or re-elect the members of the Commission. Such a decision shall be made at a meeting of the Executive Committee by at least two-thirds of the votes of the members present.
